Join your loved ones – Generous Canada

Being a student in Canada will be a special time for you and your family. On the one hand, you have to think about your studies and homework, and on the other hand, your personal life, family, wife, and children. It will probably be a difficult time. Let’s look at the positive. Having a family in Canada can be very psychologically effective and reduce the emotional pressure of immigration.

Canada’s commitment to maintaining family cohesion is to ensure that international students and their family members have the opportunity to experience life in Canada together. Regardless of whether this period lasts for a few months or a few years, international students will achieve the dream of studying in Canada with their loved ones and families.

Definition of companion – Who is companion?
Spouse or partner

By answering the following questions, you will understand the difference between spouse and common law partner.

children

Children under the age of 22 who are single are your dependent children. If the age of the children is more than 22 years old, but they are financially dependent on you due to physical or mental problems, they are still considered dependent children.

What is a minor child in the definition of immigration?

Any child who has not yet reached legal age is known as a minor child. The legal age is different in different provinces. In Alberta, Manitoba, Ontario, Prince Edward Island, Quebec and Saskatchewan, the legal age is 18. In British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut and Yukon, 19 years of age is considered the legal age.

Young children who have previously lived with at least one parent who is authorized to study or work in Canada do not need a study permit to attend preschool, elementary or secondary school. However, as soon as the child reaches legal age in their province of residence, they must obtain a study permit to continue their education in Canada.

parents

Parents of Canadian students are also considered companions. Consider the following two situations:

·        Canadian Student Parent Visa

If you have a school-aged child under 18 years old, you are allowed to accompany your student child according to Canadian government law. Therefore, you can accompany your child to Canada by obtaining a Canadian Student Parent Visa, which is a tourist visa.

To apply for a companion tourist visa, you can either submit your application at the same time as your child’s student visa application, or you can apply for a Canadian tourist visa after your child has obtained a Canadian student visa and entered Canada.

·        Canada student parent visa

If your child is over 18 years old and has obtained a Canadian student visa, you can go to Canada to visit and join him by obtaining a Canadian Student Parent Visa. Canadian student parent visa is the same as a tourist visa, but the purpose of this type of tourist visa is to visit the student’s child.

Unlike the accompanying Canadian student visa, for this type of visa, you cannot apply for an accompanying tourist visa at the same time as your child’s student visa application. Rather, you should wait for your children to get a study visa, enter Canada, and then apply for a tourist visa with the intention of visiting them.

Canada companion visa requirements

As the spouse of a Canadian student or the parent of a Canadian student, you must meet the following conditions to obtain a companion visa:

Prove that you will leave Canada after your spouse or child completes their education.
Prove that you have sufficient financial resources to cover your living expenses in Canada, separate from the living and education expenses of your spouse or child.

Converting a companion visa to work in Canada

We consider the conversion of a companion visa to a Canadian work visa in 2 cases:

·        You are the spouse of a Canadian student and you enter Canada with a tourist visa

If you go to Canada with a tourist visa to visit your student spouse, you have the option of converting your accompanying tourist visa to an Open Work Permit. In this case, you need to have sufficient reasons to change your tourist visa to a work visa and register your application from within Canada.

The conditions, documents and procedures for applying for an Open Work Permit from within Canada are the same as the conditions for applying from outside Canada, but the difference is in the duration of the case review and application registration “from within Canada”.

·        You are the parent of a student and you are entering Canada on an accompanying tourist visa

If you take a tourist visa to accompany your student child, you can convert your tourist visa to a work visa after entering Canada and if you receive a Canadian job offer from authorized Canadian employers.

The proposed work in the Canadian job classification system must be among TEER levels 0, 1, 2, 3 and the employer must obtain an LMIA license from the Canadian Ministry of Labor.

By getting a Canadian work visa, your child’s education in Canadian public schools will be free. After working for one year, you can apply for permanent residence for yourself and your child.

Canadian companion visa extension

To extend the accompanying visa, you must check the person on whom your visa is dependent (your spouse or child) and make sure that there are no problems in any way. As long as the main person of the case has no problem, you have the possibility to request the extension of the accompanying visa.

Reasons for rejection of Canadian accompanying visa

Applications for Canadian companion visas are usually rejected for the following reasons:

The purpose of the trip is not convincing to the Canadian immigration officer;
Your finances are not enough to cover the costs of living in Canada for at least one year;
Your documents and reasons are not sufficient to prove your return to your country after the completion of your spouse’s or child’s education;
Your ties to the country of origin are weak or you have ties to Canada;
Documents and information provided are incomplete or wrong.
It is stated in your spouse’s education file that you will stay in your country as your spouse’s sponsor (in cases where the companion visa application is submitted after the spouse’s study visa is issued).

Do not despair if your application for a Canadian companion visa is rejected. You still have another chance to get a visa. On the Canada Visa Rejection Reasons page, we have explained in detail about the stage after the visa rejection and the ways to fix the rejection.
